Legal Description: The following described real estate which is situate on the waters of Middle Fork, Carroll District, Lincoln County, West Virginia, to-wit:
A tract of one hundred Seventy-Seven (177) acres, more or less, situate on the waters of Middle Fork, a tributary of Mud River, in Carroll District, Lincoln County, West Virginia, of which W.H. McMellon died seized and possessed; and being part of the real estate conveyed unto the said W.H. McMellon by Regina M. Thompson, widow, by deed dated March 29, 1935, and now of record in the Office of the Clerk of the County Court of Lincoln County, West Virginia, in Deed Book 108 at Page 263, to which deed reference is here made for a more particular description.
It is understood and agreed, however, that this conveyance is subject to a conveyance by the said W.H. McMellon and others unto Homer Nida of 10.50 acres of said real estate by deed dated May 17, 1935, and now of record in the aforesaid Clerk’s Office in Deed Book 108 at page 297; and that certain conveyance by the heirs of W.H. McMellon to Jean Roberts and Eugene Roberts by deed dated December 27, 1948, and now of record in the office of the aforesaid Clerk’s office in Deed Book 134 at page 244; and subject to any other conveyance, it being the intention of the party of the first part to convey unto the party of the second part the heirship interest of Frank McMellon, Sr., in and to the remaining portion of the Old Thompson Farm situate as aforesaid.
Less that certain out-conveyance to the West Virginia Department of Highways dated August 25, 2004, by Order Vesting Indefeasible title to the West Virginia Department of Highways. Said out-conveyance to be approximately 2.29 acres, more or less, and is of record in the aforesaid Clerk’s Office in Order Book 61, at Page 555.
