Legal Description: All their right, title, and interest in and to the surface of the following hereinafter described tracts or parcels of land, being contiguous tracts of land after the out conveyances hereinafter mentioned and described in the total acreage of 45.5 acres, more or less, and situate in Clear Fork District, Raleigh County, West Virginia, on the waters of Sand Lick Creek, more particularly described as follows: 

FIRST TRACT:  Beginning at a stone corner on the Southeast side of the Sand Lick Creek just opposite the beginning Chestnut corner of the Elijah Fleshman tract of land and running with his said line Southeast to W. P. Shumate and Milton Kidd’s corner; thence with W. P. Shumate line to a double chestnut oak; thence North and with the Crawford and Ashbys’ line to a large Sugar tree on the South side of Sand Lick Creek; thence East with the Sand Lick Creek to the beginning containing 48 acres, more or less. 

The parties of the first part further grant and convey herein the 12 foot right-of-way as the road now is used and located adjoining the hereinabove described and herein conveyed First Tract. Said right-of-way extends from said First Tract out to the public road. 

This tract or parcel of land and the 12 foot right-of-way was conveyed to Clarcie Daniels by Nannie J. Dillon and C. M. Dillon, her husband, by deed dated July 29, 1932, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 113, at page 420. 

SECOND TRACT:  Beginning at a sugar tree, corner of Wilfred Daniel and Clarcie Daniel, his wife, running east on line of same, to a stone, corner of Maude Dillon’s; thence with Maude Dillon’s line North to a large chestnut; thence running with Sand Lick Road west to a stone, corner of the Crawford and Ashby’s line, running South on the Crawford and Ashby line, to the place of beginning, containing twenty-three (23) acres, more or less, and being a part of land known as the Jerry Combs’ Farm. 

There is RESERVED and EXCEPTED, however, from the operation of this deed the following hereinafter described tracts or parcels of land conveyed out of the above contiguous tracts of land as follows: 

FIRST EXCEPTION:  Beginning at a large sugar tree on the South side of Sand Lick Creek a corner as called for in a deed dated the 29th day of July, 1932, from Nannie J. Dillon and C. M. Dillon, her husband, to Clarcie Daniels of record in said Clerk’s Office in Deed Book 113, at Page 420; thence South 55° 24′ East 766.50 feet to a pine tree; thence South 13° 42′ West 186.60 feet to a pine tree; thence South 52° 22′ West 393.30 feet to a sycamore tree; thence North 28° 28′ West 782.40 feet to a chestnut oak; thence North 29° 49′ East 195.80 feet to a sugar tree and the point and place of beginning. 

And being the same tract or parcel of land conveyed to J. W. Daniels and Viola Faye Daniels, his wife, by Clarcie Daniels and W. H. Daniels, her husband, by deed dated September 18, 1952, and recorded in said Clerk’s Office in Deed Book 317, at page 295. This conveyance was further made and accepted subject to the 12 foot right-of-way out to the public road as therein set out. 

SECOND EXCEPTION:  Beginning at a corner stone on the south side of the main Sand Lick Road; thence running southwest 270 feet to the center of Main Sand Lick Creek; thence running with Sand Lick Creek as it meanders East 270 feet to a large white oak corner on the north side of Sand Lick Creek; thence north 120 feet to a locust post; thence 225 feet to a corner stone on the east side of Sand Lick Road; thence west 103 feet to the corner stone, the place of beginning and containing 7.5 acres, more or less. 

And being the same tract or parcel of land conveyed by Clarcie Daniels, widow, to James E. Daniels and Betty Dillon Daniels, his wife, by deed dated February 24, 1965, and recorded in said Clerk’s Office in Deed Book 437, at page 460. 

THIRD EXCEPTION:  Beginning at a corner stone on the south side of the main Sand Lick Road a corner to James E. Daniels and Betty Dillon Daniels, his wife; thence running with said Sand Lick Road due west 400 feet and crossing Dillon Creek to a corner stone marked “X”; thence southwest 327 feet to a corner stone on the company line and the old line fence 335 feet to a locust post set in the edge of Sand Lick Creek; thence with the meanders of Sand Lick Creek 48 feet to a large Sycamore; thence Southeast 650 feet to the line of James E. Daniels and Betty Dillon Daniels; thence north with their line 270 feet to the beginning corner and containing 10 acres, more or less. 

And being the same tract or parcel of land conveyed by Clarcie Daniels, widow, to Bobby Daniels and Alice Richmond Daniels, his wife, by deed dated July 8, 1966, and recorded in said Clerk’s Office in Deed Book 450, at page 187. 

FOURTH EXCEPTION:  Beginning at a corner of Elijah Fleshman Tract, running with the road, to a stone; thence to the creek (Sand Lick); thence up with the creek to the Fleshman tract; thence with the Fleshman tract to the beginning corner, containing one (1) (acre) more or less. 

And being the same tract or parcel of land conveyed by Clarcie Daniel and W. H. Daniel, her husband, to Virgil Phipps and Annie Phipps, his wife, by deed dated May 3, 1940, and recorded in said Clerk’s Office in Deed Book 170, at page 6. 

After the four (4) exceptions hereinabove described and particularly set out there remains 45.5 acres, mor or less, which are adjoining lands as hereinabove set out. 

Reference is hereby made to all of the above mentioned deeds for a more complete description of the property hereby conveyed.  And being the same property inherited by Mayzella Tillie Braswell (being the same person as Mayzella Tillie) by the intestacy death of her husband, Tommie Tillie, Jr., as hereinabove set forth. 

This deed is made and accepted subject to all reservations, exceptions, stipulations, agreements, easements and covenants, including mineral and mining rights heretofore made or granted in all prior instruments and conveyances made by former owners of the above described property, as fully and completely as though copied herein in full, excepting those applying to race, color, or creed. 

LESS AND EXCEPT the Following Parcel or Tract: All that certain property in which James R. Walton and Noel R. Walton, his wife, conveyed 5.00 acres, more or less, to Buford Davis and Pamela Davis, his wife, by Deed bearing the date of July 2, 2003, of record in the Office of the Clerk of the County Commission APN#: 022200230000 of Raleigh County, in Deed Book 5010 at Page 701, on July 3, 2003.0000
